Robson Hall’s Distinguished Visitors Lecture Series presents: Dr. Asad Kiyani
Asad Kiyani is an Assistant Professor at the University of Calgary’s Faculty of Law. He specializes in domestic and international criminal law, immigration and refugee law, evidence, postcolonial theory, legal pluralism, and comparative law.
Dr. Kiyani will present a paper on: “Originary Violence: Reflections on Genocide in Canada and the Colonial Legality of Ktunaxa Nation”
The decision in Ktunaxa Nation demonstrates both a problematic understanding of and adherence to ‘rule of law’, and an ongoing ontological deficit: an inability to understand Indigenous societies’ ways of being, self-organization and self-actualization. This deficit poses a key challenge to recognizing the harms suffered by Indigenous groups, and is one part of the colonial legality of modern Canadian law.
