Dr. Karen Busby
In 2010, Centre for Human Rights Research founder Karen Busby co-authored an article on the Canadian Journal of Family Law with Delaney Vun titled “Revisiting the Handmaid’s Tale: Feminist Theory Meets Empirical Research on Surrogate Mothers“. Through a review of 40 empirical research studies on women’s surrogacy experiences, the article called for a review of surrogacy laws in Canada.
In 2013, Prof. Busby and Susan Drummond (York University) co-edited a special issue of the Canadian Journal of Women and the Law devoted to feminist approaches to assisted human reproduction in Canada after the Supreme Court of Canada Reference. The special issue features articles from Françoise Baylis, Jocelyn Downie, Alana Cattapan, Stu Marvel, Vanessa Gruben, Juliet Guichon, Ian Mitchell, Christopher Doig, Marie-Andrée Jacob, Maryline Bruggeman, Claire Neirinck, Stéphanie Hennette-Vauchez, and Diane Roman. As a part of this special issue, Prof. Busby authored an article “Of Surrogate Mother Born: Parentage Determinations in Canada and Elsewhere“, which compares legislation on parentage and citizenship for children born to surrogate mothers in Canada and in other countries such as Britain and Australia.

In 2015, Prof. Busby was interviewed about potential changes to regulations related to assisted human reproduction. Prof. Busby was also prominent in conversations about regulatory changes regarding assisted human reproduction, contributing insights to articles in iPolitics, CBC News, CTV News, the Canadian Lawyer Magazine, Winnipeg Free Press, and the National Post.
In 2019, Prof. Busby became a co-investigator on a SSHRC Insight Grant titled Surrogates’ Voices: Exploring Surrogates’ Experiences and Insights. The goal of the project is to explore surrogacy practice and women’s experiences with surrogacy across Canada through interviews with Canadian surrogates. The book, Surrogacy in Canada: Critical Perspective in Law and Policy, was published with University of Toronto Press in 2018 as a result of this project. As a part of the book, Prof. Busby co-authored a chapter with Pamela M. White titled “Desperately Seeking Surrogates: Thoughts on Canada’s Emergence as an International Surrogacy Destination“.
